By registering and utilizing this Site, you signify your acceptance of this Policy. If you do not agree to the terms of this Policy, in whole or part, you should not use this Site, and should instantly cancel your registration (if you have signed up) by following the directions in “Opting-Out of Further Communications:”

Registration:

Lendiva.com only gathers personal identifiable information (“PII”) that is volunteered during the registration process or in response to specific information requests. Examples of PII that may be requested consist of name, address, email address, and telephone number. Anybody completing and submitting any of the forms (including our newsletter) on the Lendiva.com domain is considered a “registrant”. In addition, Lendiva.com may gather your IP address and information through use of electronic “cookies”.

When you register with Lendiva.com, you automatically allow registration in all the other online properties in the Lendiva.com network (collectively, the “Network Sites”). Accordingly, Lendiva.com may share registrant PII with the Network Sites.

By providing PII and other information to this Site, registrant fully understands and unambiguously consents to the collection and processing of such information in, and the transfer of such information to Network Sites, the United States and other countries or territories, in accordance with the terms of this Policy.

Use and Sharing of PII

Lendiva.com reserves the right to use registrant PII: (1) for the specific purpose for which such information was provided (including matching registrants with a payday loan company or companies); Please be aware that in the process of matching registrants with a lender or service provider we provide registrant PII to those companies. In addition, in order to determine whether your registration information meets their lending criteria they may access your credit report or credit information through a credit bureau or similar service, which may result in one or more inquiries on your credit report. (2) As disclosed at the time such information is provided (3) as disclosed in this Policy. However, please note that Lendiva.com may change this Policy at any time and therefore may in the future use registrant PII for additional purposes not currently included in this Policy.

An addition, Lendiva.com may share registrant PII with its partners, sponsors, advertisers, service providers and marketers’ lookup and reference services and any other entities that Lendiva.com believes are able to provide registrants with special offers and opportunities. Note that although Lendiva.com advises everyone who receives registrant PII from Lendiva.com to support this Policy, Lendiva.com has no control over such party’s information use practices and is not liable for any failure of such party to adhere to this Policy.

As a requirement of registration, registrants agree that Lendiva.com may share their PII with the Network Sites and unaffiliated third parties. If you do not concur that Lendiva.com may share your PII with such parties, you may

not register on Lendiva.com, and if you are already registered, you must immediately cancel your account, by following the instructions in “Opting-Out of Further Communications”.

Additionally, Lendiva.com may share Registrant PII in aggregate, non-personal form, with select marketers that wish to reach a particular target audience. This information will allow these entities to provide relevant offers to specific registrants.

Finally, Lendiva.com may disclose registrant PII in order to: (1) comply with applicable laws; (2) respond to governmental inquiries; (3) comply with valid legal process; and (4) protect the rights or property of Lendiva.com, the Network Sites or other registrants of this Site.

Do Not Call Registry Compliance:

By submitting personal contact and/or financial information through (Lendiva.com domain), the user hereby grants written permission to Lendiva.com, its affiliated sites, and its business partners for contact via telephone, mail, and/or e-mail. Further, by registering at Lendiva.com you are consenting to receive phone calls from Lendiva.com, its affiliated sites, and its business partners for contact via telephone, including but not limited to lenders that may contact you regarding a loan and thereby registrants waive their right to file a claim with the FTC or any other agency in reference to these calls or contacts.

Third Party Offers:

By registering at Lendiva.com, you may receive follow-up contacts/offers from third party companies. We cannot be responsible for the services or representations of third party advertisers.

Links to Other Sites:

Lendiva.com contains links to other sites. We are not responsible for the privacy practices or the content of such web sites.

Wireless Policy:

By opting-in you are providing consent to use personal information to provide the services you’ve requested, including services that display customized content and advertising. Your provider’s standard messaging rates apply to our confirmation and all subsequent SMS correspondence. You may opt-out and remove your SMS information by sending “STOP”, “END”, “QUIT” to the SMS text message you have received. If you remove your SMS information from our database it will no longer be used by us for secondary purposes, disclosed to third parties, or used by us or third parties to send promotional correspondence to you.

Data obtained from you in connection with this SMS service may include your name, address, cell phone number, your provider’s name, and the date, time, and content of your messages. We will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an AS IS basis.

Security, Fraud, and Abuse:

This site has security measures in place to protect the loss, misuse, and alteration of the information under our control Lendiva.com regularly reviews these measures to better protect you.

Opting-Out of Further Communications:

We provide you the opportunity to “opt-out” of having your personally identifiable information used for certain purposes, when we ask for this information. For example, if you fill out an application, and do not wish to receive any additional marketing material from us, you can indicate your preference on our website or by clicking on the link at the bottom of any email received.

You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.

Must Be 18 Years or Older:

Lendiva.com or its Network is neither intended for, nor directed to, children under the age of 18. If Lendiva.com learns that a person who registers on the Site is under the age of 18, Lendiva.com will promptly delete that individual’s registration. Legal Ages: In theUSA, the age of majority is determined individually by each state. In 47of the states, the age of majority is 18. In Nebraska and Alabama it is 19, andin Mississippi it is 21.

Transfer In Certain Circumstances:

In its sole discretion, Lendiva.com may transfer, sell or assign information collected on and through this Site, including without limitation, PII and other registrant-provided information, to one or more third parties, as a result of the sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation of Lendiva.com and/or Network Sites.

Encryption:

We strive to protect your personal information, thus, all user account pages are protected with Secure Socket Layer (“SSL”) encryption. All user accounts must be accessed with usernames and passwords. You are advised not to share your username and password with any other person. When we store and transmit sensitive information it is encrypted and is protected with SSL software. However, no data transmission over the Internet can be guaranteed to be 100% secure. We cannot warrant the security of any information that you transmit to us, and you do so at your own risk.

Data Security:

Once we receive your transmission of personal information we make reasonable efforts and industry accepted practices to keep your personal information safe. This is accomplished by preventing unauthorized access to our databases and by maintaining data accuracy. We ensure the correct use of information by establishing appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Employees who are granted access to personal information are dedicated to maintaining the security and privacy of all user information. Employees found to not be adhering to our managerial procedures are subject to disciplinary action. In some instances, Lendiva.com will enter into a privacy policy with a third party website to allow consumers to opt-in to our marketing program on those third party websites. When this occurs we make certain that the third party websites represent and warrant to us that the consumer data was collected voluntarily by consumer registration and/or co-registrations. We also require that the third party websites have a right under any applicable privacy policy to transfer the consumer data to us, and that Lendiva.com has the right to send marketing offers to the consumer. Your California Rights:

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California customer”) is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed.

Change in Policy:

Lendiva.com may, from time to time, amend this Policy, in whole or part, in its sole discretion. Depending on the nature of the change, Lendiva.com will either announce the change (1) on the privacy policy page of the site, or (2) provide such notice via e-mail to registrants. By not unsubscribing, following the announcement of any changes, you will be deemed to have agreed to such changes.
